TO: Linda Webb St. John, Tax Commissioner Chattahoochee County, Georgia; Lula L. Huff, Tax Commissioner, Muscogee County, Georgia; and any and all persons having a property right claim against the Estate of Gary Lee Conner, deceased, whomsoever, which right or claim may be affected by such Year’s Support proceeding.
The petition of LINDA JOHNSON CONNER, for a year’s support from the estate of GARY LEE CONNER, deceased, for decedent’s surviving spouse, having been duly filed, all interested persons are hereby notified to show cause, if any they have, on or before 12 p.m., December 30, 2008, why said petition should not be granted.

By virtue of the power of sale contained in a Security Deed from Terry Bowles to MORTGAGEAMERICA, Inc. dated October 19, 1999, recorded in Deed Book 10, Page 534, Chattahoochee County Records, and last assigned to Chase Home Finance LLC, conveying the after-described property to secure a Note in the original principal amount of SEVENTY-FOUR THOUSAND THREE HUNDRED EIGHTY-SIX AND 00/100 ($74,386.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of Chattahoochee County, Georgia, during the legal hours of sale on the first Tuesday, January 6, 2009 the following described property, to wit:
All that lot, tract or parcel of land situate, lying and being in Land Lot 17, 5th Land District, Chattahoochee County, Georgia, being more particularly described as follows:
Commencing at an iron pin located at the point of intersection of the western boundary of the right of way of County Road 17 (Firetower Road), a right of way eight (80) feet in width, with the northeastern boundary of a railroad right of way two hundred (200) feet in width, same being now or formally owned by Georgia Southwestern Railroad, and from said iron pin at such point of beginning, run thence north 36 degrees, 15 minutes west along the northeastern boundary of said railroad right of way for a distance of 866.59 feet to an iron pin; run thence north 89 degrees, 08 minutes, 51 seconds east for a distance of 267.21 feet to an iron pin located on the western boundary of said right of way of County Road 17; run thence south 34 degrees, 37 minutes, 09 seconds east along said western boundary of the right of way of County Road 17 for a distance of 14.71 feet to an iron pin; continue thence in a southeasterly, thence southerly direction along the arc of a curve to the right formed by the western right of way line of County Road 17 for an arc distance of 741.62 feet to an iron pin (said arc having a radius of 1,349.938 feet), said iron pin being the original true point of beginning.
The above described parcel comprises 2.764 acres more or less and is shown and designated as Parcel “B” upon a plat of survey entitled “Survey of Part of Land Lot 17, 5th Land District Chattahoochee County, Georgia” prepared by F. Wayne Allen, Ga. R.L.S. No. 1671 under date of October 14, 1993, and being recorded in Plat Book 3, Folio 304 of the records in the Office of the Clerk of the Superior Court of Chattahoochee County, Georgia.
Said property is conveyed subject to all valid and enforceable easements and restrictions of record, as presently in existence on the aforesaid property, for so long as same shall remain of binding force and effect.
The Debt secured by said Security Deed has been and is hereby declared due because of nonpayment of the indebtedness when due and in the manner provided in the Note and Security Deed. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorney’s fees, notice of intent to collect attorney’s fees having been given.
Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property Terry Bowles or, a tenant or tenants, and said property was or is commonly known as Rt. 1 Box 5258, Cusseta, GA 31805.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
